What you still need to do offline

An online draft isn’t a registered instrument by itself. To make it enforceable you print it on the applicable non-judicial stamp paper, have both parties and two witnesses sign, and get it notarised. Agreements of 12 months or more usually require registration, which is why the 11-month leave & license format is so common — see our guide on the 11-month rent agreement format.

Don’t forget TDS on higher rents

If monthly rent exceeds ₹50,000, the tenant deducts TDS under Section 194-IB at 2% (reduced from 5% with effect from 1 October 2024) and files Form 26QC. Capture both parties’ PAN in the agreement.

Why are most rent agreements in India 11 months?+

A lease of 12 months or more generally requires compulsory registration at the Sub-Registrar Office, which adds stamp duty and registration fees. An 11-month leave & license agreement is the common way to avoid mandatory registration while staying legally usable. Always verify current requirements with your local Sub-Registrar.

Is a notarised rental agreement legally valid?+

Printing the agreement on the applicable non-judicial stamp paper, signing it before two witnesses, and having it notarised makes it a valid document for most everyday purposes (address proof, deposit disputes, etc.). Registration is a separate step that is compulsory for longer terms. This tool produces a notary-ready draft; it is not itself a registered or stamped instrument.

What stamp paper value do I need?+

Stamp duty varies by state and rent/deposit value. For an 11-month leave & license in Tamil Nadu, ₹100 non-judicial stamp paper is commonly used; other states differ. The builder shows stamp-paper and registration guidance for your case, but confirm the current value with your Sub-Registrar.

Do I need to deduct TDS on rent?+

If monthly rent exceeds ₹50,000, the tenant must deduct TDS under Section 194-IB at 2% (reduced from 5% with effect from 1 October 2024) and deposit it using Form 26QC. Capture both the landlord’s and tenant’s PAN. This is informational, not tax advice.
